临时工使用期限不超过1年的临时性、季节性用工。企业招用临时工，需由企业与临时工本人签订劳动合同，并由企业向当地劳动行政部门备案。临时工的工资保险、福利待遇由国家、地区作原则性规定，用人单位与劳动者具体协商确定。临时工必须经过安全生产教育后方可上岗，从事起重工、电工、焊工、司炉工等特殊工种作业的临时工，还需进行培训并考核合格。企业与临时工签定的劳动合同期限届满时必须终止合同。解除劳动合同后，来自农村的临时工应当返回农村;来自城镇的则由当地劳动行政部门办理待业登记，并负责管理。在履行劳动合同中发生劳动争议时，按照国家有关劳动争议处理的规定办理。 临时工制度适应社会化大生产对劳动力的灵活需求。在社会化大生产过程中，企业常有些临时性、突击性、季节性的工作需要招用劳动者，而不需要常年安排劳动力，临时工即适应了生产的临时性和变换性的要求，有利于合理节约使用社会劳动力和提高企业经济效益。
