I传统租赁】传统租赁是以闲置物件为租赁标的，有约定报酬，受契约约束的商业信用行为。在中世纪的欧洲，传统租赁已经有了很大发展。当时的租赁标的从农具、马匹、房屋逐步发展到几乎所有的物件。但是这些物件都是闲置物件，因为在传统租赁中，出租人并不是以专营出租为营利手段的。出租人是否有东西可出租，取决于他是否有闲置的东西可供出租。因此，传统租赁仍是一种偶然的商品信用，带有浓厚的自然经济色彩。在我国历史上，周、秦时期就出现了传统租赁方式，汉、唐以后对土地、房产的租赁已经很普遍。 随着租赁的发展，租赁活动中的纠纷也随之增多，为了解决因租赁引起的日益增多的经济纠纷，有关租赁的法律条文和法律也陆续产生。公元6世纪中叶，东罗马的《查士丁尼法典》中就有关于租赁的详细条文。1289年英国的《威士尔法》是有关租赁的最早的单行法。
