专利权人依专利许可合同允许他人实施其专利的权利：获得权益的行为和制度，通常把通过签订专利许可合同而进行的交易称为许可证贸易，专利权许可由如下几种：（1）、一般许可：专利权人许可他方在规定的时间、地域内享有对专利使用权后、自己仍保留着实施，同样在同一地域内就同样专利再许可任何第三方使用，（2）、排他许可；专利权人可保留这份权利外，不得再将同一许可证发给任何第三人；（3）、独占许可专利权人许可他方在规定的时间和地域内享对专利的使用权后，不仅无权向第三人发放该权利的许可证，而且自己也不得在合同期限使用该权利,(4)、分合同；专利权人许可他方在规定的时间地域内使用该专利的同时，又允许许可方将自己的专利许可给任何第三人使用。――――《法学大辞典》第一版113页，总主编；邹喻，顾明，中国政法大学出版社。
