婚姻的有效与无效是建立在婚姻成立的基础上,由于我国婚姻法未能区分婚姻的成立要件与婚姻的有效要件,以致关于婚姻效力的立法存在着不少缺陷,尤其是关于无效婚姻制度的立法。
