| 环境公害 environmental hazard 由于人类活动而引起的环境污染和生态系统破坏，对公众安全、健康、生命、财产以及生产和生活造成的严重危害。又称 公害。日本在1896年的《河川法》中第一次采用“公害”，系相对于“公益”的用语，指河流侵蚀、妨碍航运等对公众的危害。后在其环境法中，将由于事业活动及人类其他活动而造成的相当范围的大气污染、水污染、土壤污染、噪声、振动、地面沉降、恶臭、妨碍日照和通风等称为环境公害。据英美法的妨扰理论，凡影响三人以上并侵害他们作为公众成员而应当享有的权益，如清洁大气、清洁水、宁静等的妨扰称为公害。公害是一种应负刑事责任的罪过。根据此理论，凡影响三人以上的大气污染、水污染等环境污染和生态系统破坏是法律规定的公害，对此，公民均可对污染者提起诉讼。中国在1978年颁布的《中华人民共和国宪法》中首次采用公害一词。在中国，凡污染和破坏生态环境从而对公众的健康、安全、生命以及公私财产等造成的危害均为公害。 |
