产品质量侵权损害赔偿产品的生产者、销售者或供货者因产品缺陷致使他人受到损害时，承担以恢复或弥补他人所受损害为目的的民事责任的一种主要形式。损害赔偿是对受害人的法律补救，也是对加害人的法律制裁。根据《中华人民共和国产品质量法》和《中华人民共和国民法》的有关规定，产品质量侵权损害赔偿包括如下内容: 责任主体承担产品质量侵权损害赔偿的责任主体是缺陷产品的生产者、销售者或供货者。生产者对损害赔偿承担无过错责任，销售者对损害赔偿承担过错责任。销售者即使对产品缺陷的存在无过错的，在不能指明缺陷产品的生产者或供货者时，也应当承担赔偿责任。 使权损害赔偿的范围产品质量侵权损害赔偿的范围包括对人身伤害的赔偿和对财产损失的赔偿。①人身伤害指因产品存在缺陷造成消费者人体和健康的损害。它分为一般伤害、致残伤害和致人死亡三种情况。一般人身伤害指受害人通过治疗，能够恢复到受损害前的身体状态。在这种情况下，侵害人应当赔偿医疗费和因误工减少的收入。医疗费指受害人为恢复健康所花费用，包括药费、手术费、住院费、护理费、交通费等。受害人因误工减少的收入是以收入的实际损失计算的，包括工资、奖金和补贴的减少等。如受害人没有工资收入，则赔偿标准以当地一般临时工的工资标准为限。致残伤害，加害人除赔偿受害人医疗费、因误工减少的收入外，还应赔偿残疾人生活补助费，如残疾人购置轮椅，定期更换假肢，以及必要的护理费、营养费等。致人死亡，加害人除赔偿受害人死亡前所支付的医疗费、误工减少的收入外，还应支付死者的丧葬费、抚恤费及生前抚养的人必要的生活费等费用。②财产损失指除缺陷产品以外的其他财产损失，包括财产的实际损失和间接经济损失。对财产损失的赔偿，首先应当恢复原状。如无法恢复原状的，侵害人可以按照该财产的现行价格将其折算成货币进行赔偿。有下列情形之一的.生产者可以免予赔偿:第一，未将产品投入流通的;第二，产品投入流通时.引起损害的缺陷尚不存在的;第三，将产品投入流通时的科学技术水平尚不能发现缺陷的存在的
