临时建设是指必须限期拆除、结构简易、临时性的建筑物、构筑物、道路、管线或其他设施;临时用地是指由于建设工程施工、堆料或其他原因,需要临时使用并限期收回的土地。批准临时建设和临时用地的使用期限,一般均不超过两年。
临时建设和临时用地都对城市规划的实施产生重要的影响,因此,城市规划行政主管部门必须对城市规划区内的临时建设和临时用地进行严格的规划管理。任何单位和个人需要在城市规划区内临时使用土地或进行临时建设都应当征得城市规划行政主管部门的同意,不得影响城市规划的实施。
鉴于临时建设和临时用地的情况比较复杂,各地的管理体制和管理条件又不尽相同,因此,《城市规划法》第三十三条规定:“在城市规划区内进行临时建设,必须在批准的使用期限内拆除。临时建设和临时用地具体规划管理办法由省、自治区、直辖市人民政府制定。”
