国际承包工程中的担保为了维护当事人的合法利益，保证人向受益人出具保函，一旦委托人发生损害受益人利益而不予或无法赔偿时，由保证人代替委托人向受益人赔偿一定损失的行为。承包工程中的当事人，包括委托人(即投标人或中标人，也可能是业主)、受益人(即招标人、业主，也可以是承包商)和保证人(银行、保险公司或其他金融机构)。保证书(保函)的种类有:①投标保证书，用于保证投标人在决标签约之前不撤标;②履约保证书，用于防止中标人不履行合同的义务;③预付款保证书，用于担保承包商按合同规定偿还业主已支付的全部预付款;④维修保证书.担保承包商对完工后的工程缺陷进行维修;⑤临时进口物资税收保证书，担保承包商在工程竣工后将临时进口的免税施工机具设备运出工程所在国，或在永久留下这些机具设备时按规定照章纳税。以上这些保证书的使用目的和范围各不相同.所以其保证的期限、费用、赔偿办法也有不同.要根据每项承包工程的特点和具体情况选择不同的担保。担保的共同点在于它们都属于备用性质的信用。如果没有发生违约或违反相关内容，就不发生赔偿间题。出具保证书时，应尽量避免使用单独的或首次要求即付的保证书因为出具这样的保证书，受益人只要提出索赔，不管能否提出有效的索赔证明.按国际惯例.保证人就得赔偿。故这是一种单方面有利于受益人而不利于委托人的不公平的担保形式，是不可取的。
