This thesis has mainly discussed the problems existed in current quality supervision punishments, including problems like the random use of the laws and regulations, the function overlaps with other departments, the disharmony between the quality supervision administrations and the administrative subjects, etc.
本文笔者从实务的角度提出质量技术监督行政处罚存在的问题,包括在适用不同层级法律规范时具有随意性、与其他部门存在大量的职能交叉现象、处罚机关与相对人间关系不够和谐、违反法定程序及与其他法律衔接的问题,并从立法、执法主体、执法程序、执法环境、执法理念和监督机制等方面做出了成因分析,提出了完善质量技术监督处罚领域立法、解决职能交叉、构建和谐质监理念下的人性化执法体系及完善行政处罚监督机制的初步设想,力求能为质量技术监督行政机关今后正确、及时而有效地行使行政处罚权提供思路,同时能对保障行政相对人的合法权益,实现真正意义上的依法行政起一些积极作用。
