基于双重委托代理关系的框架,分析我国银行治理结构具有内在缺陷,认为国有资产管理人作为国有资产代理人不能对银行高级管理人员实施监督和激励;由于银行风险内控机制低效,使直接针对银行的监管措施不能有效地约束银行高级管理人员的经营行为。

【《中华人民共和国银行管理暂行条例》公布】 1986年1月，国务院发布《中华人民共和国银行管理暂行条例》，条例规定，凡经营存款、贷款、个人储蓄、票据贴现、外汇、结算、信托、投资、金融租赁、代募证券等项业务的银行和其他金融机构，都应当遵守条例，并同时规定人民银行、各专业银行及其他金融机构、货币发行管理、信贷资金管理、利率管理、存贷款、结算管理等方面的条款，并对金融机构违反上述各条例作出了“违法处理”方面的条款规定。
