| 减刑 commutation 对服刑期间确有悔改或立功表现的犯罪分子，依法减轻其原判刑罚的制度。 罪犯在服刑期间确有悔改或立功表现，即符合下列条件之一者可依法减刑：①遵守监规纪律，积极改造，确有认罪服法表现的。②揭发、检举监内外反革命分子或者其他刑事犯罪分子的重大破坏活动，经查证属实的。③在生产中有重大发明创造的。④在抗御自然灾害或者排除重大事故中表现突出的。⑤对国家和人民有其他重大贡献的。 《中华人民共和国刑法》规定，被判处管制、拘役、有期徒刑、无期徒刑的犯罪分子，在执行期间，如果认真遵守监视、接受教育改造，确有悔改或立功表现，可以减刑。减刑以后实际执行的刑期，凡判处管制、拘役、有期徒刑的 ，不能少于原判刑期的1／2。凡判处无期徒刑的不能少于10年，无期徒刑减为有期徒刑的刑期从裁定减刑之日起计算。死刑缓期执行的减刑，另有特别规定，即在缓期执行期间如果没有故意犯罪，2 年期满以后减为无期徒刑；如确有重大立功表现，2年期满以后，减为15年以上20年以下有期徒刑，其刑期从裁定减刑之日起计算。减刑必须由执行机关提出书面意见，报请当地人民法院审核裁定。 |
